Welcome to MySkillsFuture.gov.sg, a multi-tenanted learning and content management system with extensions to various current and next-generation virtual learning applications and environments, as well as related technology-enabled learning services. The MySkillsFuture.gov.sg website and any subdomains, subpages, applications and services related to or linked from MySkillsFuture.gov.sg (collectively referred to as the “Digital Service”) are provided by SkillsFuture Singapore (“SSG”, “we” “us” or “our”).
These terms of use (these “Terms”) govern the Visitors’ (as defined below, “you” or “your”) access to and use of the Digital Service.
Definitions
In these Terms, the following terms shall have the meanings set forth below:
“Career Resources” refers to a depository of articles on personal development, tips and inspirational stories.
“Course Directory” refers to the compilation of courses on the Digital Service.
"Digital Service” refers to MySkillsFuture.gov.sg and any subdomains, subpages, applications and/or services related to or linked from MySkillsFuture.gov.sg. Examples of such Digital Service include but are not limited to the Course Directory, Self-Assessment Tool and Career Resources.
“Digital Service Content” refers to all information, text, images, data, links, or other material posted on the sections of the Digital Service: (i) that are publicly available; and (ii) which you have the right to access, whether created by us or provided by a third party for display on the Digital Service.
“Individual” refers to an individual user who logs in and accesses the Digital Service using his Singpass.
“Personal Data” refers to data, whether true or not, about an individual who can be identified (a) from that data, or (b) from that data and other information to which the agency has or is likely to have access.
“Privacy Statement” refers to SSG’s Privacy Statement as amended from time to time and published on MySkillsFuture.gov.sg.
“Self-Assessment Tool” refers to a set of online assessments that help the Individuals to better understand themselves in terms of career and skills.
“Singpass” refers to the common user ID and password used to access the Singapore government’s online services.
“Terms” refer to these Terms of Use.
“Training Partners” refers to the training partners who have their course(s) listed on the Course Directory.
“Users” collectively refer to Individuals, Training Partners and Visitors, and each are referred to as “User”.
“User Content” refers to information posted by Individuals and Training Partners in the form of text, images, photographs, video, audio and graphics that are available on the Digital Service.
“Visitor” refers to a user who browses the Digital Service without logging in as an Individual or a Training Partner.
Acceptance of Terms
Please read these Terms carefully as they create a binding contract between you and SSG.
If you are an individual, you represent and warrant that you are at least eighteen (18) years old and that you have read, understood and accepted these Terms. In the event that you are below eighteen (18) years of age, you confirm that you have your parent’s or legal guardian’s consent to these Terms.
Please review these Terms before using the Digital Service. If you do not agree to these Terms, then you must immediately discontinue your use of the Digital Service.
We reserve the right to change these Terms from time to time for any reason. Access to and use of the Digital Service are subject to these Terms, as they are amended from time to time and published on the Digital Service. Your continued access to and use of the Digital Service shall constitute your agreement to the revised Terms.
Access to the Digital Service
As a Visitor, you can browse, view and use parts of the Digital Service. You must be logged in with your Singpass to gain access to certain parts of the Digital Service. The access to such services will depend on the manner in which you log in using your Singpass, whether as an Individual or Training Partner. SSG may alter, suspend, or discontinue the Digital Service in whole or in part, at any time and for any reason, without notice. The Digital Service may also periodically become unavailable due to maintenance or malfunction of computer equipment or for other reasons.
You confirm that you are aware of and acknowledge that SSG shall have no liability in respect of such potential alteration, suspension, discontinuance, unavailability and/or removal.
If you use our Digital Service on your mobile device, your mobile carrier’s normal rates and charges apply. We are not responsible for any charges you incur from your mobile carrier as a result of use of the Digital Service. You are responsible for ensuring that at all times while using the Digital Service you are not in violation of your wireless data service agreement. You are solely responsible for all fees and costs associated with your access to and use of the Digital Service.
Use of Digital Service
You represent, warrant and covenant that:
a. You will not reproduce, distribute, publicly display, publicly perform, communicate to the public, create derivative works from or otherwise use and exploit any Digital Service Content or the Digital Service except as permitted by these Terms or the terms and conditions of the relevant Training Partners as applicable;
b. You will assume responsibility for controlling how your Personal Data is disclosed or used on the Digital Service, including, without limitation, taking appropriate steps to protect such information; and
c. You will not harass and/or solicit personal information from any Users.
SSG’s Privacy Statement
Our Privacy Statement sets out how we process data, including Personal Data, in our possession or control.
Digital Service Content
Subject to these Terms, SSG hereby grants to you a personal, non-transferable, non-exclusive, non-sublicensable right and licence to access and use the Digital Service, and all Digital Service Content therein, solely within the scope of your status as a Visitor.
SSG reserves the right to make changes to document names and content, descriptions or specifications of products or services, or other information without obligation to issue any notice of such changes.
Nothing contained on this Digital Service should be construed as granting, by implication, estoppel, or otherwise, any license or right to use this Digital Service through the use of framing or otherwise, except: (a) as expressly permitted by these Terms; or (b) with our prior written permission or the permission of such third party that may own the trademark or copyright of material displayed on this Digital Service.
User Content
SSG is not responsible or liable for the conduct of Users or for views, opinions and statements expressed in User Content submitted for display through the Digital Service. Information submitted to the Digital Service is not screened. With respect to such User Content posted on or through the Digital Service, the Digital Service acts as a passive conduit for such distribution and SSG is not responsible for such User Content. Any opinions, advice, statements, services, offers, or other information in the Digital Service provided by Users are those of the respective author(s) or distributor(s) and not of SSG. We neither endorse nor guarantee the accuracy, completeness, or usefulness of any such User Content. SSG shall not be responsible for any breach of any contractual obligation or infringement of any third-party rights.
Monitoring
SSG has the right, but not the obligation, to monitor User Content submitted through or posted on the Digital Service, to determine compliance with these Terms and any other applicable rules that we may establish, from time to time. SSG has the right in our sole discretion to edit or remove any material submitted to or posted in any online discussion forum or chat room provided through our Digital Service. Without limiting the foregoing, SSG has the right to remove any material that SSG, in our sole discretion, finds to be in violation of these Terms or otherwise objectionable.
Links to External Websites
The Digital Service may contain links to websites which are not operated or controlled by SSG, whether for marketing purposes or otherwise. These links are provided to you as a matter of convenience, and SSG does not make any representation or warranty whatsoever in respect of any linked website and shall not be responsible for the content of any linked website. Any non-SSG website accessed from the Digital Service is independent from SSG and SSG does not have any control over the content of that website. In addition, a link to any non-SSG website from the Digital Service does not imply that SSG endorses or accepts any responsibility for the content or use of such website. Use of any external website is subject to its terms of service and privacy policy. You are responsible for exercising caution and good judgment when using external websites.

Except as set forth below, caching and links to, and the framing of the Digital Service or any of the User Content and/or Digital Service Content is strictly prohibited.

ALL DIGITAL SERVICE CONTENT AND USER CONTENT AND INFORMATION ON OR ACCESSIBLE FROM THE DIGITAL SERVICE ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SSG DOES NOT WARRANT AND SSG HEREBY DISCLAIMS ANY WARRANTY:
a. AS TO THE ACCURACY, CORRECTNESS, COMPLETENESS, RELIABILITY, TIMELINESS, NON-INFRINGEMENT, TITLE, MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE OF THE DIGITAL SERVICE CONTENT OR USER CONTENT OR THE DIGITAL SERVICE; AND

Indemnification
You hereby agree to indemnify, hold harmless and defend SSG and its affiliates, officers, directors, agents, partners, employees, licensors and representatives from any claims, damages, losses, liabilities, and all costs and expenses of defence, including but not limited to, legal fees, resulting directly or indirectly from a claim that arises in connection with your use of the Digital Service.
Notwithstanding the indemnification given by you, SSG shall have the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you under this Clause, and in such case, you agree to fully cooperate as reasonably required with such defence and in asserting any available defences.
Limitation of Liability
In no event shall SSG, its affiliates, officers, directors, agents, partners, employees, licensors and/or representatives be liable to you or any other person or entity for any direct, indirect, special, incidental, consequential or exemplary damages (including, but not limited to, damages for loss of profits, loss of data, loss of use, or costs of obtaining substitute goods or services) arising out of the use, inability to use, unauthorised access to or use or misuse of the Digital Service, questions, comments, content or any information contained thereon, whether based upon warranty, contract, tort (including negligence), or otherwise, even if SSG has been advised of the possibility of such damages or losses.
Proprietary Rights
This Digital Service, including the Digital Service Content, is protected by copyright, trademarks and other forms of proprietary rights. All rights, title and interest in the Digital Service Content are owned by, licensed to or controlled by SSG.
Unless otherwise stated in the copyright attribution of any Digital Service Content, SSG has the sole copyright to all works on the Digital Service.
All rights are reserved. No part of any works on the Digital Service may be reproduced, stored in a retrieval system, or transmitted in any form or by any means, whether electronic, mechanical, photocopying, recording, or otherwise, without written permission from SSG.
Restrictions on Use
The Digital Service may not be used for any illegal purpose or in any manner inconsistent with these Terms. Except as otherwise provided, the Digital Service Content shall not be reproduced, republished, uploaded, posted, transmitted, adapted, modified or otherwise displayed or distributed in any way, without the prior written permission of SSG.
Modification of any of the Digital Service Content or use of the Digital Service Content for any other purpose will be a violation of SSG's copyright and other intellectual property rights. Graphics, photographs, video, audio, software programs and images on the Digital Service are protected by copyright and other proprietary rights and may not be reproduced, published, distributed, copied, modified or appropriated or exploited in any manner without written permission of SSG.
Jurisdictional Issues
SSG does not make any representation that information on the Digital Service is appropriate or available for use outside Singapore. Those who choose to access the Digital Service from outside Singapore do so on their own initiative and at their own risk and are responsible for compliance with applicable local laws. By using the Digital Service, you consent to having your Personal Data transferred to and processed in Singapore, subject to the restrictions on such data applicable to SSG.
Termination
SSG reserves all rights to deny or restrict access to the Digital Service by any particular person, or to block access from a particular IP address to the Digital Service, at any time, without ascribing any reasons whatsoever.
Governing Law
These Terms shall be governed by and construed according to the laws of Singapore and subject to the exclusive jurisdiction of the Singapore Courts. In the event of any dispute arising out of or in connection with these Terms including any question regarding its existence, validity or termination, the parties shall at first instance take reasonable efforts to settle and resolve such disputes in good faith and in an amicable manner by negotiation.

Course Directory
The Course Directory is available on the Digital Service and accessible to all Users. The Course Directory provides information of various courses by Training Partners so as to enable Users to search for and contact the Training Partners if they wish to attend the Training Partners’ courses available.
The Course Directory is provided to you as a matter of convenience, and SSG makes no representation or warranty whatsoever in respect of any Training Partners listed in the Course Directory and shall not be responsible for the quality or suitability of any of the Training Partners for any purpose whatsoever. In addition, a listing on the Course Directory does not imply that SSG endorses any of the Training Partners. Engagement of the Training Partners shall be at your own risk and you agree that SSG shall not be responsible whatsoever for any such engagement. You acknowledge that the courses are offered by the Training Partners and agree that SSG shall not be liable for any loss, whether direct, indirect, consequential, incidental or special (and whether arising out of contract, tort or otherwise) which you may suffer arising from any defect, error, fault or failure to perform with respect to the courses provided by the Training Partners.

Users of the Self-Assessment Tool are bound by the disclaimer on the Self-Assessment Tool segment on the Digital Service and the disclaimer set out in these Terms above.

Access to the Digital Service
In order to log in and access the Digital Service as an Individual, you will require a valid Singpass. Upon the expiration or termination of your Singpass, you will not be able to log in to and access the Digital Service. While any Visitor or Training Partner can browse, view and use parts of the Digital Service, you must be logged in with your Singpass as an Individual in order to create a profile. You are solely responsible for maintaining the confidentiality of your access and use of the Digital Service using your Singpass as an Individual. You agree that you will not divulge or share access information of your Singpass and access to the Digital Service using the same with any third party for any reason.
During your first login to the Digital Service, or any subsequent login, you may be prompted or required to enter additional information, including but not limited to your name, email address and contact number. You represent and warrant that all information provided by you is accurate, current and complete and undertake to maintain and update your information to keep it accurate, current and complete.
You acknowledge that if any information by you is untrue, inaccurate, not current or incomplete, SSG may suspend your access to the Digital Service and the Digital Service Content without any liability to you. SSG may alter, suspend, or discontinue the Digital Service in whole or in part, at any time and for any reason, without notice. The Digital Service may also periodically become unavailable due to maintenance or malfunction of computer equipment or for other reasons.
SSG further reserves the right to remove any User Content uploaded by you that is in breach of these Terms, including but not limited to offensive, defamatory or libellous statements.
You confirm that you are aware of and acknowledge that SSG shall have no liability in respect of such potential alteration, suspension, discontinuance, unavailability and/or removal.

Use of Digital Service

b. You will not post any inappropriate, offensive, racist, hateful, sexist, pornographic, false, misleading, infringing, defamatory or libellous content;
c. You will not reproduce, distribute, publicly display, publicly perform, communicate to the public, create derivative works from or otherwise use and exploit any Digital Service Content or the Digital Service except as permitted by these Terms or the terms and conditions of the relevant Training Partners as applicable;
d. You will assume responsibility for controlling how your Personal Data is disclosed or used on the Digital Service, including, without limitation, taking appropriate steps to protect such information; and
e. You will not harass and/or solicit personal information from any Users.
SSG’s Privacy Statement
Our Privacy Statement sets out how we process data, including Personal Data, in our possession or control. Where there is Interaction, it is a direct transaction between the Training Partners and/or any other third party and you and does not involve SSG in any way.
SSG will not be responsible for the manner in which Personal Data is collected or used by the Training Partners and/or any third party. SSG does not manage or monitor the collection of Personal Data done by the Training Partners and/or any third party.
SSG shall not be responsible for the Interaction between the Training Partners and/or any third party and you. SSG expressly disclaims any liability or claims that may arise from the Interaction. In the event that you have a dispute with any of the Training Partners and/or any third party, you agree that SSG shall not have any liability in respect of such dispute and hereby release SSG (and its officers, directors, agents, subsidiaries, and employees) from any and all claims, demands, or damages (actual or consequential) of every kind, known and unknown arising out of or in any way related with such disputes.
Digital Service Content

Under no circumstances will SSG be liable for any loss or damage caused by your reliance on any information communicated or provided on or through the Digital Service, or any information contained therein when you access the Digital Service as an Individual.
ALL DIGITAL SERVICE CONTENT AND USER CONTENT AND INFORMATION ON OR ACCESSIBLE FROM THE DIGITAL SERVICE ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SSG DOES NOT WARRANT AND SSG HEREBY DISCLAIMS ANY WARRANTY:
a. AS TO THE ACCURACY, CORRECTNESS, COMPLETENESS, RELIABILITY, TIMELINESS, NON-INFRINGEMENT, TITLE, MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE OF THE DIGITAL SERVICE CONTENT OR USER CONTENT OR THE DIGITAL SERVICE; AND

THAT THE DIGITAL SERVICE, THE USER CONTENT AND/OR THE DIGITAL SERVICE CONTENT OR ANY FUNCTIONS ASSOCIATED THEREWITH WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED OR THAT THE DIGITAL SERVICE AND THE SERVER IS AND WILL BE FREE OF ALL VIRUSES, WORMS AND/OR OTHER HARMFUL OR INVASIVE ELEMENTS.
SSG SHALL NOT BE LIABLE FOR ANY INJURY, DAMAGE OR LOSS OF ANY KIND CAUSED AS A RESULT (DIRECT OR INDIRECT) OF THE USE OF THE DIGITAL SERVICE, INCLUDING BUT NOT LIMITED TO ANY INJURY, DAMAGE OR LOSS SUFFERED AS A RESULT OF RELIANCE ON THE CONTENTS CONTAINED IN OR AVAILABLE FROM THE DIGITAL SERVICE. NEITHER SSG NOR ANY OF ITS THIRD PARTY AGENTS SHALL HAVE ANY RESPONSIBILITY OR LIABILITY FOR ANY INJURY, DAMAGE OR LOSS CAUSED BY ANY NEGLIGENCE, OMISSION OR FAULT OF SSG AND/OR ITS EMPLOYEES, AGENTS OR SUB-CONTRACTORS IN CONNECTION WITH THE DIGITAL SERVICE.
SSG SHALL NOT BE RESPONSIBLE FOR THE INTERACTION BETWEEN YOU AND/OR OTHER USERS AND/OR ANY THIRD PARTY. SSG SHALL NOT BE RESPONSIBLE FOR DISPUTES, CLAIMS, LOSSES, INJURIES, OR DAMAGE OF ANY KIND THAT MIGHT ARISE OUT OF OR RELATE TO CONDUCT OF OTHER USERS AND/OR ANY THIRD PARTY, INCLUDING, BUT NOT LIMITED TO, ANY USER'S RELIANCE UPON ANY INFORMATION PROVIDED BY SUCH OTHER USERS AND/OR ANY THIRD PARTY. SSG DOES NOT CONTROL CONTENT FROM OTHER USERS AND/OR ANY THIRD PARTY POSTED ON THE DIGITAL SERVICE AND, AS SUCH, SSG DOES NOT GUARANTEE IN ANY MANNER THE RELIABILITY, VALIDITY, ACCURACY OR TRUTHFULNESS OF SUCH CONTENT. YOU ALSO UNDERSTAND THAT USING THE DIGITAL SERVICE MAY EXPOSE YOU TO CONTENT THAT YOU CONSIDER OFFENSIVE, INDECENT, OR OBJECTIONABLE. SSG SHALL NOT HAVE ANY RESPONSIBILITY TO KEEP SUCH CONTENT FROM YOU AND SHALL NOT BEAR ANY LIABILITY FOR YOUR ACCESS OR USE OF ANY SUBMITTED CONTENT, TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAW. Indemnification
You hereby agree to indemnify, hold harmless and defend SSG and its affiliates, officers, directors, agents, partners, employees, licensors and representatives from any claims, damages, losses, liabilities, and all costs and expenses of defence, including but not limited to, legal fees, resulting directly or indirectly from a claim that arises in connection with your use of the Digital Service.
Notwithstanding the indemnification given by you, SSG shall have the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you under this Clause, and in such case, you agree to fully cooperate as reasonably required with such defence and in asserting any available defences.
Limitation of Liability
In no event shall SSG, its affiliates, officers, directors, agents, partners, employees, licensors and/or representatives be liable to you or any other person or entity for any direct, indirect, special, incidental, consequential or exemplary damages (including, but not limited to, damages for loss of profits, loss of data, loss of use, or costs of obtaining substitute goods or services) arising out of the use, inability to use, unauthorised access to or use or misuse of the Digital Service, questions, comments, content or any information contained thereon, whether based upon warranty, contract, tort (including negligence), or otherwise, even if SSG has been advised of the possibility of such damages or losses.
Proprietary Rights
This Digital Service, including the Digital Service Content, is protected by copyright, trademarks and other forms of proprietary rights. All rights, title and interest in the Digital Service Content are owned by, licensed to or controlled by SSG.
Unless otherwise stated in the copyright attribution of any Digital Service Content, SSG has the sole copyright to all works on the Digital Service.
All rights are reserved. No part of any works on the Digital Service may be reproduced, stored in a retrieval system, or transmitted in any form or by any means, whether electronic, mechanical, photocopying, recording, or otherwise, without written permission from SSG.
Restrictions on Use
The Digital Service may not be used for any illegal purpose or in any manner inconsistent with these Terms. Except as otherwise provided, the Digital Service Content shall not be reproduced, republished, uploaded, posted, transmitted, adapted, modified or otherwise displayed or distributed in any way, without the prior written permission of SSG.
Modification of any of the Digital Service Content or use of the Digital Service Content for any other purpose will be a violation of SSG's copyright and other intellectual property rights. Graphics, photographs, video, audio, software programs and images on the Digital Service are protected by copyright and other proprietary rights and may not be reproduced, published, distributed, copied, modified or appropriated or exploited in any manner without written permission of SSG.
Jurisdictional Issues
SSG does not make any representation that information on the Digital Service is appropriate or available for use outside Singapore. Those who choose to access the Digital Service from outside Singapore do so on their own initiative and at their own risk and are responsible for compliance with applicable local laws. By using the Digital Service, you consent to having your Personal Data transferred to and processed in Singapore, subject to the restrictions on such data applicable to SSG.
Termination
SSG reserves all rights to deny or restrict access to the Digital Service by any particular person, or to block access from a particular IP address to the Digital Service, at any time, without ascribing any reasons whatsoever.
We may suspend your access to the Digital Service, in our sole discretion, for any reason and at any time, upon electronic notice to you at the e-mail address provided by you during your initial login to the Digital Service. We may discontinue offering the Digital Service at any time.
We have no obligation to retain your data including Personal Data for any period of time beyond what may be required by applicable law. Upon termination of your Singpass, your access to the Digital Service will automatically cease. All representations and warranties shall survive termination.
Governing Law
These Terms shall be governed by and construed according to the laws of Singapore and subject to the exclusive jurisdiction of the Singapore Courts. In the event of any dispute arising out of or in connection with these Terms including any question regarding its existence, validity or termination, the parties shall at first instance take reasonable efforts to settle and resolve such disputes in good faith and in an amicable manner by negotiation.

Course Directory
The Course Directory is available on the Digital Service and accessible to all Users. The Course Directory provides information of various courses by Training Partners so as to enable Users to search for and contact the Training Partners if they wish to attend the Training Partners’ courses available.
The Course Directory is provided to you as a matter of convenience, and SSG makes no representation or warranty whatsoever in respect of any Training Partners listed in the Course Directory and shall not be responsible for the quality or suitability of any of the Training Partners for any purpose whatsoever. In addition, a listing on the Course Directory does not imply that SSG endorses any of the Training Partners. Engagement of the Training Partners shall be at your own risk and you agree that SSG shall not be responsible whatsoever for any such engagement. You acknowledge that the courses are offered by the Training Partners and agree that SSG shall not be liable for any loss, whether direct, indirect, consequential, incidental or special (and whether arising out of contract, tort or otherwise) which you may suffer arising from any defect, error, fault or failure to perform with respect to the courses provided by the Training Partners.
